What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant was served with an N4 Notice and failed to pay the arrears before the application was filed. Despite making some payments after the filing, a balance remained at the time of the hearing. The Tenant did not attend the hearing.

The ruling

The tenancy is terminated effective August 19, 2025, unless the Tenant pays $1,780.66 to void the order. If the Tenant moves out, the Landlord actually owes the Tenant $962.47 because the rent deposit, interest, and post-application payments exceed the rent owed up to the hearing date and the filing fee. Daily compensation of $49.24 applies for each day the Tenant stays past August 5, 2025.
