What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant did not void the N4 notice by paying the rent arrears. The Tenant had sublet the unit to an unauthorized occupant, Selwyn Porter, who was present at the hearing.
The ruling
The tenancy is terminated unless the Tenant pays $14,164.44 by December 31, 2023 to void the order. If the Tenant does not pay, the Tenant and the unauthorized occupant must vacate the unit by December 31, 2023. The Tenant must also pay $7,829.31 to the Landlord, which includes rent arrears and the application filing fee, minus the rent deposit and interest.
