What happened

The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. A valid N4 notice was served. The Tenant did not attend the hearing but had paid $3,000.00 since the application was filed. Despite the partial payment, substantial arrears remained. The Board determined that the tenancy should be terminated unless the Tenant pays the full amount required to void the order.

The ruling

The tenancy is terminated effective February 1, 2026, unless the Tenant pays $7,374.36 by January 31, 2026, or $9,422.02 by February 1, 2026, to void the order. If the Tenant does not void the order and fails to move out, the Landlord may enforce the eviction through the Sheriff starting February 2, 2026. If the tenancy is terminated, the Tenant is ordered to pay $3,781.62 plus daily compensation of $67.32 until they vacate.
