What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to substantial rent arrears. The Tenant admitted to the arrears, explaining that she had been hospitalized earlier in the year, which led to her financial difficulties. She proposed a repayment plan of $200 per week, but the Member found this plan unviable as the Tenant lacked a stable income and the proposed payments were less than the monthly rent. While the Member acknowledged the Tenant's personal hardships, the eviction was granted with a delay until November 30, 2025, to allow her time to find new housing.
The ruling
The tenancy is terminated effective November 30, 2025, unless the Tenant voids the order by paying $14,084.41. If the Tenant does not void the order, she must vacate by November 30, 2025, and pay the Landlord $5,482.47 (the arrears and filing fee minus the deposit and interest), plus daily compensation of $76.82 until she moves out.
