What happened
The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. By the time of the hearing, the Tenant had paid all rent arrears up to August 31, 2025. The core dispute remained whether the Tenant was responsible for the Landlord's $185.95 filing fee. The Tenant claimed he had dropped off the March rent payment in person and that the Landlord lost it, while the Landlord maintained the payment was never received until months later.
The ruling
The Tenant is ordered to pay the Landlord $185.95 for the application filing fee by September 2, 2025. Relief from eviction was granted because the Tenant had cleared all rent arrears prior to the hearing. The Board found the Tenant responsible for the filing fee because he did not act with sufficient diligence to ensure rent was received after being notified of a missing payment.
