What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to substantial rent arrears. The Tenant, who attended the hearing, admitted to the arrears but explained he was waiting for a pension withdrawal from his union to settle the debt. The Landlord declined to offer further time as no payments had been made for several months. The Board found the tenancy was no longer viable due to the significant debt and lack of supporting evidence for the Tenant's claims.

The ruling

The tenancy is terminated effective August 18, 2025, unless the Tenant pays $13,804.16 to void the order. If the Tenant fails to void the order, he must move out by August 18, 2025, and pay the Landlord $10,991.99, which reflects the arrears up to the hearing date and the filing fee, minus the deposit and interest. Daily compensation of $36.92 applies starting July 15, 2025.
