What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and charges related to NSF cheques. The Tenant did not attend the hearing. The Landlord provided evidence of rent arrears and unpaid administration/bank fees resulting from two returned cheques. The LTB found the N4 notice valid and that the Tenant failed to void it by paying the arrears before the application was filed.

The ruling

The tenancy is terminated effective August 2, 2025, unless the Tenant voids the order by paying $8,407.82 by July 31, 2025, or $9,779.07 by August 2, 2025. If the Tenant does not pay and does not vacate, the Landlord may enforce eviction through the Sheriff starting August 3, 2025. The Tenant is ordered to pay $6,246.86 to the Landlord plus $45.08 per day in compensation until they vacate.
