What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to significant rent arrears. The case is complicated by the fact that the rental unit is currently uninhabitable due to a flood and is subject to ongoing litigation. Tenant 1, who is on Ontario Works and has two children, requested a postponement of the eviction to find alternative housing or income solutions.
The ruling
The LTB ordered the termination of the tenancy due to non-payment of rent, but postponed the eviction until August 31, 2025, providing the Tenants time to relocate given the unit is uninhabitable. The Tenants can void the order by paying $5,116.32 by July 31, 2025, or $6,603.85 by August 31, 2025. If they do not void the order, they are ordered to pay $1,910.51 to the Landlord, which accounts for arrears up to the hearing date minus the rent deposit and interest.
