What happened

The Landlord applied for the termination of the tenancy and eviction of the Tenants due to non-payment of rent. The Landlord also sought charges for NSF fees. Despite being served with the notice of hearing, the Tenants did not attend. The Landlord provided evidence that the Tenants owed significant arrears and had not responded to offers for a payment plan. The Landlord's claim for NSF fees was denied because the payments were made via pre-authorized debit rather than cheques.

The ruling

The tenancy is terminated effective August 19, 2025, unless the Tenants pay $3,863.17 to void the order by that date. If the Tenants do not void the order, they must vacate the unit and pay the Landlord $263.93 (which accounts for arrears and filing fees minus the rent deposit and interest), plus daily compensation of $64.44 until they move out.
