What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to rent arrears. The Tenants had not made any rent payments since the application was filed. Tenant 2 testified that she believed ODSP had been sending payments directly to the Landlord's head office by cheque, but the Landlord denied receiving any such payments and no evidence was provided to substantiate the Tenant's claim. The Member found that the arrears were significant but allowed a short postponement of the eviction to account for potential administrative issues with ODSP.
The ruling
The tenancy is terminated unless the Tenants pay $6,908.10 by October 31, 2025, or $8,252.52 by November 15, 2025. If the order is not voided, the Tenants must move out by November 15, 2025, and pay the Landlord $4,845.63 plus daily compensation of $44.20 from October 15, 2025, until they vacate.
