What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants failed to attend the hearing despite being properly served. Evidence presented showed substantial rent arrears and the service of a valid N4 notice. Although the Tenants made a partial payment after the application was filed, the arrears remained significant.
The ruling
The tenancy is terminated effective October 4, 2025, unless the Tenants pay the required amount to void the order. If the Tenants do not void the order, they must move out by October 4, 2025. The Tenants are ordered to pay $6,636.43, which accounts for arrears to the hearing date and filing fees, minus the rent deposit and interest. Daily compensation of $59.18 is required for each day they remain in the unit after September 10, 2025.
