What happened
The Landlord filed an application to terminate the tenancy and evict the Tenant for non-payment of rent. A former co-tenant, Gerald McMasters, was removed as a party as he had vacated the unit before the N4 notice was issued. The remaining Tenant, Jessica Lefervre, was still in possession at the time of the hearing and had accrued significant rent arrears. The Tenant indicated an intention to vacate by April 30, 2025.
The ruling
The tenancy is terminated unless the Tenant pays $15,776.00 to the Landlord by June 30, 2025. If the Tenant does not pay and fails to move out by June 30, 2025, the Landlord can file for eviction. If the tenancy terminates, the Tenant is ordered to pay the Landlord $11,942.80 for arrears up to the hearing date plus the filing fee, and $47.18 per day from April 11, 2025, until they vacate.
