What happened

The Landlords applied for termination of the tenancy because they require the unit for their daughter's residential use. The daughter currently commutes 1.5 hours for work and wishes to live closer to her office and live independently. The Tenant contested the application, alleging the notice was retaliatory following maintenance requests and requested relief from eviction due to unemployment and difficulty finding a new home.

The ruling

The LTB ordered the termination of the tenancy effective January 31, 2026. The Landlords successfully proved their daughter's genuine intent to occupy the unit. However, due to the Tenant's current unemployment and hardship, the eviction was postponed from the original requested date to January 31, 2026. The Landlords had already paid the mandatory one-month compensation.
