What happened

The landlord applied for an order to terminate the tenancy and evict the tenant because the tenant did not meet a condition specified in a previous order issued by the LTB on September 6, 2022. The condition was that the tenant was required to maintain the rental unit in an ordinary state of cleanliness up to September 30, 2023, but the landlord found the unit in an unclean and cluttered state on December 29, 2022, preventing effective pest control treatment. The landlord also received complaints from other tenants about foul smells coming from the tenant's unit.

The ruling

The tenancy between the landlord and the tenant is terminated. The tenant must move out of the rental unit on or before May 29, 2023. If the unit is not vacated by that date, the landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction.
