What happened

The Landlord applied for eviction after the Tenant allegedly breached a previous conditional consent order by committing theft. The Landlord provided video evidence showing the Tenant taking another resident's cell phone from the building's vestibule. The Tenant filed a motion to set aside the resulting ex-parte eviction order, arguing she had no intent to steal and intended to return the phone.

The ruling

The Tenant's motion to set aside the eviction order is denied. The Board found the Tenant breached a prior conditional order by stealing a cell phone from another resident. The eviction is upheld, but the stay is extended until November 30, 2025, to allow the Tenant time to find alternate housing due to her health and personal circumstances.
