What happened

The Landlord applied to terminate the tenancy and evict the Tenants because they failed to pay rent. A valid N4 Notice was served, but the Tenants did not pay the arrears to void it. The Tenants vacated the rental unit prior to the hearing. The LTB calculated the arrears up to the move-out date and ordered payment of the balance after applying the rent deposit and interest.

The ruling

The tenancy was terminated effective May 31, 2025, when the Tenants vacated the unit. The Tenants are ordered to pay the Landlord $808.43 by August 19, 2025. This amount includes rent arrears and the filing fee, minus the rent deposit and interest. Post-judgment interest will accrue if the amount is not paid by the due date.
