The landlord applied for an order to terminate the tenancy and evict the tenant because the tenant did not meet a condition specified in the mediated settlement signed by the parties on March 9, 2023, with respect to a previous application.

The ruling

The tenancy is terminated effective May 8, 2023. The tenant must pay the landlord $1,638.48 (less any payments made after the application was filed) for rent arrears and the cost of the previous application. The tenant must also pay the landlord $23.80 per day for compensation for use of the unit starting April 28, 2023 until the tenant moves out.
