What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. One tenant attended the hearing, stating the other tenant was away in China.
The ruling
The tenancy is terminated unless the tenants pay $14,972.52 by September 30, 2023 or $16,629.49 by October 31, 2023 to void the order. If the tenancy is terminated, the tenants must pay $12,421.55 to the landlord, which includes rent arrears and filing fees, minus the rent deposit and interest. The tenants must also pay daily compensation of $54.48 from September 15, 2023 until they vacate.
