What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to significant rent arrears. The Landlord served a valid N4 notice which the Tenants did not void. The Tenants failed to attend the hearing despite being properly served. Evidence presented indicated the Tenants had not made any payments since the application was filed, and an occupancy check by the Landlord suggested they might not be present at the unit.

The ruling

The tenancy is terminated effective September 30, 2025, unless the Tenants pay $24,595.00 by that date to void the order. If not voided, the Tenants must vacate by October 3, 2025. The Tenants are ordered to pay the Landlord $23,956.00 for arrears up to the hearing date and the filing fee, plus $28.50 per day in compensation from September 9, 2025, until they move out. Post-judgment interest of 4.00% applies from October 4, 2025.
