What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to significant rent arrears. As of the hearing date, the Tenants owed over $23,000. Tenant 2 appeared at the hearing and requested a three-month extension to the eviction date to secure alternative housing or funds. The Landlord opposed this, citing a history of non-payment and financial prejudice. The Adjudicator found that a payment plan was not viable given the Tenants' financial circumstances and income levels.
The ruling
The tenancy is terminated effective July 22, 2025. The Tenants must pay $20,915.01 to the Landlord to cover arrears up to the hearing date and the filing fee, after deducting the rent deposit and interest. To void the eviction and continue the tenancy, the Tenants must pay $26,736.00 by July 22, 2025. Daily compensation of $96.99 applies for each day the Tenants remain after July 2, 2025.
