What happened

Landlord applied for orders to terminate the tenancy and evict the Tenants due to non-payment of rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, which the Tenants did not void. The Tenant, Debi Facey, attended the hearing, while the former Tenant, Jordan Michael Besito, had vacated the unit prior to the hearing.

The ruling

The tenancy is terminated effective October 16, 2023. The Tenant must pay the Landlord $25,358.46, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit. If the Tenant does not pay the full amount by October 16, 2023, the Tenant will owe interest at 7% annually on the outstanding balance starting October 17, 2023. If the unit is not vacated by October 16, 2023, the Landlord may file the order with the Court Enforcement Office for enforcement.
