What happened
The landlord applied for an order to terminate the tenancy and evict the tenants due to the tenants' failure to meet a condition specified in a previous order issued by the LTB on October 12, 2022. The previous order required the tenants to not make excessive noise such as sounds of yelling, screaming, or breaking things.
The ruling
The tenancy between the landlord and the tenants is terminated. The tenants must move out of the rental unit on or before May 27, 2023. If the unit is not vacated by that date, the landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The tenants shall also pay the landlord $33.93 per day for compensation for the use of the unit starting May 17, 2023 until the date the tenants move out. The landlord shall deduct any amounts the tenants owe from the rent deposit and interest on the rent deposit being held by the landlord.
