What happened
The Landlord applied to end the tenancy to use the unit for its own non-residential purposes. The Tenant appealed the Landlord and Tenant Board's decision to grant the eviction. The Landlord brought a motion to quash the Tenant's appeal.
The ruling
The court quashed the Tenant's appeal of the Landlord and Tenant Board's eviction order, finding it manifestly devoid of merit and an abuse of process. The stay on the eviction order was lifted, allowing the Landlord to file the eviction order with the Sheriff on February 28, 2020.
