What happened

The Landlord discovered individuals living in the rental unit who had entered into a tenancy agreement with a third party who lacked the legal authority to rent the premises. The Landlord and the individuals attempted to negotiate a new tenancy agreement, but the individuals made material modifications to the draft lease which the Landlord did not accept. The Landlord subsequently sought an order declaring them unauthorized occupants and requested compensation for the period they occupied the unit.

The ruling

The Board found that the individuals were unauthorized occupants as no valid tenancy agreement was formed. The Occupants were ordered to pay the Landlord $7,253.41. This total includes $10,553.41 in daily compensation for the period between October 1, 2020, and January 15, 2021, minus the $3,000.00 already paid to the Landlord and minus $300.00 in adjournment costs awarded to the Occupants due to the Landlord's unreasonable procedural delays.
