What happened

The Landlord applied for an order to terminate the tenancy for personal use, stating he required the unit for his own residential occupation. This need arose after he separated from his partner and sold their shared home. The Landlord served a valid N12 notice and paid the required one month's rent as compensation. The Tenant did not attend the scheduled videoconference hearing.

The ruling

The tenancy is terminated. The Tenant is ordered to vacate the rental unit by April 28, 2025. The Board found that the Landlord requires the unit for his own personal use in good faith, having satisfied all legal requirements including serving an N12 notice and paying compensation. Relief from eviction was not granted as it was deemed unfair under the circumstances, and the Tenant was not present to argue for it.
