What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser in good faith requires possession of the rental unit for the purpose of residential occupation.

The ruling

The Landlord's application is dismissed due to the invalid N12 notices of termination. The Landlord served conflicting N12 notices, indicating both the Landlord's and the Purchaser's intention to occupy the rental unit, which are directly in conflict and negate each other. The Tenant would be reasonably confused by the conflicting notices. The Landlord is ordered to pay $200 in costs to the Tenant.
