What happened

Tenant applied for an order determining that Landlord collected or retained money illegally. The Tenant testified that she had a fixed-term lease from June 10, 2022 to June 9, 2023, and that she vacated the unit on March 25, 2023 after giving improper notice. The Landlord re-rented the unit on May 20, 2023.

The ruling

The Landlord collected rent in excess of the amount allowed by the Residential Tenancies Act, 2006. The Tenant is entitled to a refund of $1,433.75, which includes $1,380.75 for excess rent collected and $53.00 for the cost of filing the application.
