What happened

Tenants applied for an order determining that the Landlords gave a notice of termination in bad faith on behalf of the Purchaser. The Tenants vacated the rental unit as a result of the N12 notice, but the Purchaser did not move into the unit within a reasonable time.

The ruling

The Tenants proved the Landlords served the N12 notice in good faith, but the Purchaser acted in bad faith by not moving in and instead re-renting the unit at a higher price. The Purchaser must pay the Tenants $11,803 for increased rent, moving expenses, and general compensation.
