What happened
The Landlord sought to terminate the tenancy and evict the Tenants due to significant rent arrears exceeding $10,000. The Tenants, who have resided in the unit since early 2024, proposed a payment plan to address the arrears while maintaining ongoing rent. While acknowledging their financial difficulties and debts, the Landlord highlighted personal financial strain and the absence of any payments since June 2025. The Board found the Tenants' financial disclosures incomplete regarding their debt obligations.
The ruling
The tenancy is terminated effective December 31, 2025, unless the Tenants pay the required amounts to void the order. If the Tenants do not void the order, they are ordered to pay the Landlord $6,012.94 for arrears up to the hearing date plus daily compensation of $82.19 from October 8, 2025, until they move out. The eviction is postponed until year-end to allow the Tenants time to relocate, given their financial circumstances.
