What happened

The Landlord applied to evict the Tenant due to substantial interference and illegal acts committed by the Tenant's guests. These acts included breaking into another unit, theft, smoking unknown substances in common areas, and vandalism. The Tenant was served an N5 notice but failed to correct the behaviour. The Tenant did not attend the hearing. Evidence showed the disruptive behaviour continued, culminating in a homicide within the rental unit and attacks on a neighboring tenant.

The ruling

The tenancy is terminated, and the Tenant must vacate the unit by April 14, 2025. The Tenant is ordered to pay the Landlord $186.00 for the application fee, plus daily compensation of $3.98 from April 1, 2025, until move-out. Relief from eviction was denied due to the severity of the guests' conduct, including theft, drug use, attacks on a neighbor, and a homicide in the unit.
