What happened

Landlord applied for an order to terminate the tenancy and evict the Tenants due to their failure to pay rent as required by a previous LTB order. The Tenants failed to pay the lawful rent on or before April 1, 2023, and also failed to pay $2,500 towards rent arrears by April 15, 2023, as required by the previous order.

The ruling

The tenancy is terminated effective June 4, 2023. The Tenants must pay the Landlord $17,034.52, which includes rent arrears up to May 24, 2023, and the cost of the previous application, less the rent deposit and interest owed on the deposit. The Tenants must also pay the Landlord $55.71 per day for compensation for use of the unit starting May 25, 2023, until the Tenants move out.
