What happened
The Landlords applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. During the hearing, the Tenants revealed they had moved out approximately three months prior without notifying the Landlords. The Tenants attempted to raise issues for a rent offset, but were procedurally barred because they failed to provide advance notice or evidence as required by LTB Rules 19.4 and 19.5.
The ruling
The tenancy is terminated effective June 30, 2025. The Tenants are ordered to pay the Landlords $9,037.54 for rent arrears and the application fee, after deducting the rent deposit and interest. If the amount is not paid by August 8, 2025, interest will accrue at 4% per year.
