What happened

Tenant 1 and Tenant 2 filed an application claiming that Landlord harassed, obstructed, threatened, and interfered with them. They also alleged they were not given 72 hours to remove property following an eviction by the Sheriff. The Landlord argued that he is actually a tenant of the property owner and shared a kitchen with the Applicants, meaning the Residential Tenancies Act does not apply to their arrangement.

The Landlord and Tenant Board determined it has no jurisdiction over the matter because the Respondent is himself a tenant and shared a kitchen with the Applicants, excluding the relationship from the protections and regulations of the Residential Tenancies Act, 2006.
