What happened
The Landlord applied for the termination of the tenancy and eviction of the Tenant due to non-payment of rent and requested NSF charges. The Tenant remained in possession at the time of the hearing. There was a legal dispute regarding whether NSF charges could be applied to failed electronic payments as opposed to paper cheques.
The ruling
The tenancy is terminated effective August 16, 2025, unless the Tenant pays $3,824.00 to void the order. If the Tenant does not pay and move out, the Landlord may enforce eviction through the Sheriff. If terminated, the Tenant owes the Landlord $651.62 plus daily compensation of $25.78 until vacating.
