What happened
The Landlord applied to evict the Tenant for non-payment of rent. The Tenant disputed the lawful rent, claiming a 2019 rent increase was illegal. The Board found that because the Tenant paid the increased rent for over 12 consecutive months without filing a dispute, the rent was deemed lawful under s. 135.1 of the RTA. Due to the minimal amount of arrears ($24.36), the Landlord did not seek eviction at the hearing, and the Board granted the Tenant relief from eviction.
The ruling
The tenancy is not terminated. The Tenant is granted relief from eviction but must pay the Landlord $210.36, which consists of $24.36 in rent arrears and the $186.00 application fee. The payment is due by June 9, 2025.
