What happened
The Landlord applied to terminate the tenancy and evict the Tenant because the Tenant's employment as an assistant superintendent ended. Under the Act, a superintendent's tenancy terminates when their employment ends. The Landlord also sought daily compensation for the period the Tenant remained in the unit after the one-week statutory grace period following employment termination. A legal debate ensued regarding whether the LTB has the statutory authority to award compensation for overholding when a tenancy ends by operation of law rather than by notice or agreement.
The ruling
The tenancy is terminated effective September 14, 2025. The Tenant is ordered to vacate the unit and pay the Landlord $9,430.08, which includes daily compensation for overholding and the application filing fee. The Tenant must also pay $62.47 per day for each day they remain in the unit after June 2, 2025, until they move out.
