What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served a valid N4 notice. The Tenant failed to pay the arrears and vacated the rental unit on April 1, 2025, prior to the hearing date. The Landlord sought a monetary order for the arrears accumulated up to the move-out date.

The ruling

The tenancy was terminated effective April 1, 2025, the date the Tenant moved out. The Tenant is ordered to pay the Landlord $5,307.73 by October 4, 2025. This amount consists of $6,500.00 in arrears and the $186.00 filing fee, less the $1,300.00 rent deposit and $78.27 in interest on that deposit. Post-order interest of 4% per annum applies if not paid by the due date.
