What happened
Tenants filed an application against the Landlord for failing to meet maintenance obligations regarding heating. The Tenants reported a lack of heat from the electric radiators starting in late November 2023. Repairs were not fully completed until late February 2024. During this period, the Tenants used space heaters, leading to increased hydro costs. One tenant was also recovering from hospitalization in the cold unit.
The ruling
The Landlord is ordered to pay the Tenants $1,084.81 by November 6, 2025. This includes a 15% rent abatement ($962.61) for the 91-day period without adequate heat, $74.20 for increased hydro costs, and the $48.00 filing fee. The abatement was limited to 15% due to the Tenants' failure to mitigate losses by refusing a temporary heater and failing to follow up for several weeks.
