What happened

The Landlords applied to terminate the tenancy and evict the Tenant due to substantial rent arrears. The Tenant had not paid rent since April 2024, accumulating over $17,000 in debt. At the hearing, the Tenant sought an adjournment to find legal counsel and attempted to raise maintenance issues without having filed evidence in advance. The Member denied the adjournment and the section 82 maintenance claims, citing the length of time the Tenant had to prepare and the prejudice to the Landlords given the high arrears.

The ruling

The tenancy is terminated effective May 13, 2025, unless the Tenant voids the order by paying $18,963.00. If the Tenant does not pay and move out, the Landlords may enforce the eviction through the Sheriff. The Tenant is ordered to pay $16,917.70 to the Landlords, reflecting arrears minus the deposit and interest, plus daily compensation of $29.11 until the unit is vacated.
