What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant, a long-term resident since 2011 with two children, admitted to the arrears but requested relief from eviction based on personal and financial challenges. The Tenant had made a substantial payment of $5,000.00 after the application was filed and proposed a structured payment plan to clear the remaining balance.
The ruling
The LTB ordered the Tenant to pay $17,684.00 in arrears and costs. However, eviction was denied on the condition that the Tenant follows a payment plan: $1,000.00 per month toward arrears (starting Dec 21, 2025) plus regular monthly rent. If any payment is missed, the Landlord may apply for an eviction order without further notice to the Tenant.
