What happened

The Landlord applied to terminate the tenancy and evict the Tenants for non-payment of rent. After an order was issued in March 2025, the Tenants requested a review. They argued that the denial of an adjournment at the original hearing was unreasonable and that the Member erred by refusing to consider maintenance issues because the evidence was disclosed late. The LTB reviewed these claims and determined that procedural rules were followed correctly.

The ruling

The request to review the original eviction order is denied. The Board found that there was no serious error in the initial hearing's conduct. Specifically, the denial of an adjournment and the exclusion of maintenance evidence (due to late disclosure by the Tenants) were consistent with legal requirements and procedural rules. The original order issued on March 28, 2025, remains unchanged.
