What happened
The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to meet a condition specified in the mediated settlement signed by the parties on a previous application.
The ruling
The tenancy is terminated, and the tenant must move out by April 15, 2023. If the unit is not vacated by that date, the landlord may file the order with the Court Enforcement Office for enforcement. The tenant must pay the landlord $13,959.44 (less any payments made after the application was filed) for rent arrears and the application filing fee, as well as $44.61 per day in compensation for use of the unit starting April 5, 2023 until the tenant moves out. If the full amount is not paid by April 15, 2023, the tenant will owe interest at 6% annually on the outstanding balance.
