What happened

The Landlord applied to terminate the tenancy and evict the Tenants because they knowingly and materially misrepresented their household income, which affected their rent-geared-to-income (RGI) subsidy. An investigation revealed the Tenants were actually living in Hamilton, Ontario, while holding a subsidized unit in Toronto and failing to report significant employment income.

The ruling

The tenancy is terminated effective July 15, 2025. The Tenants are ordered to pay the Landlord $35,186.00, representing the maximum monetary jurisdiction for misrepresented income and the filing fee. Relief from eviction was denied because the Tenants already have alternative housing in Hamilton and are using a social housing unit that could be given to a family in need.
