What happened
The Landlord initially applied for an order to terminate the tenancy and evict the Tenant, claiming a breach of a previous payment plan order. An eviction order was issued on August 26, 2025, without a hearing. The Tenant filed a motion to set aside that order, asserting that no breach occurred and that all required payments were made via ODSP.
The ruling
The LTB granted the Tenant's motion to set aside the eviction order dated August 26, 2025. The Tenant provided undisputed evidence through ODSP statements that the rent and arrears payments were made directly to the Landlord. As there was no breach of the previous payment order, the eviction order is set aside and cannot be enforced.
