What happened

The Landlord applied for an order to terminate the tenancy because the Tenant transferred occupancy of the Rent-Geared-to-Income (RGI) rental unit to unauthorized occupants without consent. Evidence provided by a Landlord investigator and a special constable showed that the Tenant had been absent from the unit for approximately two years while unauthorized individuals resided there. The Tenant argued the application was late and cited personal disabilities as grounds for relief, but the Landlord contended this was a serious breach of the public housing system.

The ruling

The tenancy is terminated effective November 16, 2025. The Tenant and any unauthorized occupants must vacate by this date. The Tenant is ordered to pay $186.00 to the Landlord for the application filing cost. Relief from eviction was denied due to the Tenant's serious breach of the public housing mandate and the fact that the Tenant has alternative RGI housing available.
