What happened

The Landlord applied to terminate the tenancy because the Tenant breached a condition of a previous LTB order dated April 3, 2025, which required the Tenant to clear egress pathways. An inspection on May 6, 2025, revealed excessive clutter and combustible items stacked over waist-height. The Tenant was evicted on June 27, 2025, and subsequently filed a motion to set aside the eviction order three months later. The Tenant cited mental health issues and functional limitations as reasons for the delay and the condition of the unit.

The ruling

The Tenant's motion to set aside the eviction order is denied. The stay of the original order is lifted immediately. The Tenant remains evicted as he failed to comply with previous cleaning conditions and refused multiple offers of assistance from the Landlord and community agencies.
