What happened

Landlord applied to terminate the tenancy and evict the Tenant due to the Tenant's failure to keep the rental unit in a state of ordinary cleanliness, including excessive clutter blocking pathways and improper egress, as well as unsanitary conditions in the bathroom. The Landlord alleged the Tenant's conduct substantially interfered with the Landlord's and other tenants' reasonable enjoyment and lawful rights, and seriously impaired the safety of others in the residential complex.

The ruling

The Landlord has proven the grounds for termination of the tenancy, but the Tenant will be granted relief from eviction subject to conditions. The Tenant must declutter the rental unit to maintain adequate pathways and egress, clean the bathroom, and maintain the unit in a reasonable state of cleanliness and sanitary condition for 2 years. The Landlord may inspect the unit every 2 months to confirm compliance, and the Tenant must pay the $186 application filing fee. If the Tenant fails to comply with the conditions, the Landlord may apply to terminate the tenancy without notice to the Tenant.
