What happened

The Landlord obtained an eviction order without a hearing after the Tenant breached a previous consent order regarding rent arrears. The Tenant filed a motion to set aside the eviction order, citing financial theft from his bank account and health issues. The Board found that the Tenant had not paid rent since October 2024 and, despite his circumstances, it would be unfair to the Landlord to set aside the order.

The ruling

The Tenant's motion to set aside the eviction order issued on January 3, 2025, is denied. The stay of the eviction order is lifted effective May 31, 2025, providing the Tenant extra time to find alternate housing due to his age and health limitations.
