What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
The ruling
The Tenants are ordered to pay $2,839 to the Landlords, which includes rent arrears up to July 31, 2023 and the application filing fee, minus the rent deposit and interest on the deposit. The Tenants are granted a payment plan of 18 months to pay the arrears, and must also pay the ongoing monthly rent on time and in full. If the Tenants fail to make any of the scheduled payments, the Landlords may apply to terminate the tenancy.
