What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to rent arrears. However, during the hearing, the N4 notice was found to be defective because it contained inaccurate arrears amounts and was not properly visible to the Tenant on the Landlord's portal. The application was converted to an L9 for arrears only.
The ruling
The LTB ruled that the Landlord's N4 notice was defective due to significant accounting errors and a technical glitch where the notice appeared blank on the Tenant's portal. As the eviction was denied, the Landlord converted the application to an L9. The Tenant was ordered to pay $5,501.59 for rent arrears and the application fee by September 29, 2025.
